Working and starting a business in Asia: choose the legal route first
A local job, remote work and operating your own company are different immigration cases. Start with permission to perform the activity, not with job boards or incorporation packages.
Three routes that should not be mixed
| Scenario | Check first | Common mistake |
|---|---|---|
| Local employment | sponsor, occupation and salary test | applying without checking pass eligibility |
| Remote work | whether remote activity is permitted | treating visitor status as work permission |
| Own business | right to manage, licences and capital | assuming ownership grants work rights |
Compare destinations in five checks
- Occupation restrictions and local-hire rules.
- Employer sponsorship and what happens after job loss.
- The exact income or capital test.
- Dependant status and a spouse's work rights.
- Tax residence, which is separate from immigration status.
A practical shortlist
Career hubs
Singapore and Hong Kong reward strong profiles but demand salary and housing headroom.
Regional bases
Malaysia and Thailand may be easier day to day, but remote-work and company routes need separate checks.
Specialist markets
Taiwan, Japan and South Korea can suit qualified candidates; language and hiring vary sharply by sector.
Before you act
- open the official immigration source;
- get the role and sponsor in writing;
- confirm permission before starting work;
- model net income after tax, insurance and rent;
- never pay for a “guaranteed visa”.
Employment
Assess the offer, not only the vacancy
Ask the employer to identify the legal entity, role, location, fixed salary, probation and sponsorship support in writing. Then match the offer to the official pass: qualifications, experience, occupation, salary threshold and employer requirements. “We will arrange it after you start” is a material warning sign.
Model job loss before accepting. Confirm the time available to change sponsor or leave, whether insurance continues, what happens to dependants and how a sudden move affects the housing deposit. The more the status depends on one employer, the larger the reserve should be.
Remote work
An overseas client does not remove local rules
Separate four questions: where the work is physically performed, who pays, whether there are local clients, and which status permits the activity. A digital-nomad or remote-work route may exclude local work and require income evidence, insurance and an overseas contract. Visitor status is generally designed for visiting, not regular employment.
Tax is another analysis. Immigration permission, tax residence and income source are governed by different tests. A day count is useful, but “183 days” is not a universal answer for every country or income type.
Own business
Company, licence and personal status are separate
Low-cost online incorporation does not prove that a founder can legally operate in the country. Check foreign ownership, sector licensing, directors, premises, capital, local hiring and accounting. Then confirm the owner's or director's personal work permission.
Budget beyond setup: renewals, accountant, payroll, banking checks, insurance, workspace and closure. If an agent quotes only incorporation, ask for the full first- and second-year cost.
Red flags
When to stop
- approval is “guaranteed” without a passport and profile review;
- you are told to work before the permit is issued;
- no authority or exact category is identified;
- you must pay for a vacancy or transfer to a personal account;
- renewal, family and closure costs are hidden.
A sound route fits one sentence: “I perform this activity on this legal basis, supported by this official document.” If that sentence is unclear, the plan is not ready.
Offer comparison
Turn every option into the same worksheet
For each destination, record the legal route, sponsor, processing dependency, fixed compensation, expected net income, housing range, insurance, family rights and exit cost. Use the same currency and the same time period. A slightly lower salary can be the stronger offer when housing, healthcare and status are more stable.
Add a confidence column. Mark a fact “official” only when an authority publishes it, “contractual” when it appears in a signed offer, and “estimate” when it comes from listings or personal reports. This prevents a precise government rule from being mixed with a volatile rent estimate or an agent's promise.
Run three scenarios: normal employment, delayed permit, and early termination. The delayed case needs temporary housing and cash; the termination case needs the legal time to change status, return travel and deposit risk. Founders should run a fourth scenario in which banking or licensing takes twice as long as expected.
Frequently asked
Short answers to common planning questions
Should I incorporate before choosing a visa?
Usually not until the company structure and your personal work rights have been assessed together. A company certificate does not replace immigration permission.
Is a digital-nomad route the same as a work visa?
No. It can authorise a narrower pattern of overseas work and may restrict local clients or employment. Read the permitted-activity wording.
Which country is best for a job search?
The best starting point is the country where your occupation, salary and employer can satisfy a real pass category. Use our country finder for a shortlist, then verify the route.
