Taxes in Asia for Expats: Residence, Income and Filing

Short answer: a visa does not decide your tax position. Tax residence, income source, where work is performed, remittance rules and departure-country obligations can all apply at the same time.

Count days, map income and obtain advice before changing payroll, remitting investment income or assuming that foreign clients make remote work tax-free.

This guide is a decision framework, not a personal tax calculation. Rules vary by nationality, treaty access, family ties, company structure and year, so every material action should be checked with the relevant tax authority and a qualified cross-border adviser.

Five questions that determine the real tax problem

  1. Where are you tax resident? A day count may be only one of several tests.
  2. Where is the income sourced? Work performed in the destination can be locally sourced even when the payer is abroad.
  3. When was it earned, paid and remitted? Those dates can have different consequences.
  4. Does a treaty apply? A treaty can relieve double taxation but rarely removes all filing duties.
  5. What remains in the departure country? Citizenship, domicile, property, a company or continuing workdays may keep obligations alive.

Residence thresholds are a starting point, not the answer

JurisdictionInitial residence screenWhat the simple number misses
Thailand180 days or more in a calendar yearThai-source income and rules for assessable foreign income remitted by a resident
Malaysia182 days, plus linked and historical testsAlternative residence routes and whether work is Malaysian-source
Singapore183 days, with special multi-year employment rulesResident and non-resident rates, work-pass review and Singapore-source income
Vietnam183-day and accommodation testsWorldwide taxable income for residents and proof of residence elsewhere
Hong KongNo simple domestic day-count basis for salaries taxTerritorial source analysis and treaty residence are separate questions

Do not use this table to file a return. It is a screening map based on the authorities and current professional summaries checked in October 2026. Malaysia, for example, has linked-period and historical tests beyond 182 days. Singapore can treat qualifying continuous employment across two or three years differently. Vietnam can consider accommodation as well as presence.

Remote salary is not automatically foreign income

The location of the employer's bank account is not necessarily the source of employment income. If you perform duties while physically present in the destination, local law may treat the salary as locally sourced. A digital nomad visa may authorise the immigration scenario but does not promise a tax exemption.

For freelancers and owners, the analysis can become wider: where services are performed, where contracts are managed, where a company is effectively controlled and whether a permanent establishment or local registration is created. Separate the personal tax question from the company question.

Foreign income and remittances

“Territorial tax system” does not mean “no tax.” It normally means the law distinguishes local-source and foreign-source income, but the definitions and remittance treatment differ. Thailand's Revenue Department states that a resident is liable on Thai-source income and on qualifying foreign-source income brought into Thailand; current guidance should be checked for the year and income type. Singapore's IRAS states that most foreign-sourced income received by individuals is exempt, with exceptions. Malaysia's tax authority also publishes its own foreign-income rules and exemptions.

Keep evidence of the earning period, invoices, employment duties, bank transfers, capital statements and exchange rates. Moving old savings is not the same factual event as remitting current income, but without records the distinction can become difficult to demonstrate.

Double taxation treaties do not erase administration

When two countries treat you as resident under domestic law, an applicable treaty may use a sequence such as permanent home, centre of vital interests, habitual abode and nationality. Tax paid in one country may become a credit in another. That still can require two returns, residence certificates and evidence that the income and tax match.

Never assume a “183-day rule” protects short-term remote work by itself. Treaty employment relief usually has several conditions involving presence, the employer and whether a local permanent establishment bears the cost.

Records to build before the move

  • A day log with arrivals, departures, work location and temporary absences.
  • An income map separating salary, freelance fees, dividends, interest, rent, pensions, gains and crypto activity.
  • A timeline for when each amount was earned, invoiced, paid and remitted.
  • Employment contracts, client contracts and evidence of where duties were performed.
  • Departure-country residence analysis, property and company ties.
  • Tax certificates, withholding statements, returns and treaty residence certificates.

Keep the original-currency amount and the rate used in each filing. A spreadsheet based only on bank receipts is rarely enough for income earned across several countries.

A practical 30-day tax checklist

Before departure: download prior returns, confirm exit rules, document asset cost bases and decide who will handle mail and filings. During the first month: start the day log, preserve entry records, ask payroll which entity pays and withholds, and avoid large unexplained transfers. Before the first filing: reconcile all income, withholding and remittances, obtain tax residence certificates where relevant and confirm deadlines.

Use the banking guide to prepare KYC and transfer records, then compare the legal stay in the visa section. Immigration, banking and tax records should tell the same story.

Frequently asked questions

Does a digital nomad visa make foreign salary tax-free?

No. Immigration permission and tax liability are different systems unless an explicit tax rule says otherwise.

Am I safe if I stay fewer than 183 days?

Not necessarily. Thresholds differ, accommodation or ties can matter, and locally sourced work may be taxable for a non-resident.

Can a treaty prevent double taxation?

It may allocate residence or provide a credit or exemption, but evidence and filings can still be required in both countries.
